When purchasing a product using the Lili June services you are accepting our Terms & Conditions of Sale. When you place an order on our website you are making a contract with Lili June Company.

 

www.lilijune.com (the “Website” and related services) is operated by the Lili June Company (“we”, “us” and “our”). Our registered office is 16 Birch Grove, Cambuslang, G72 7LW, Scotland.

 

ORDERING WITH US

You agree that your order is an offer to purchase the product(s) listed in your order to us on the Terms. You agree that an order is engaging in a contract with Lili June Company. All orders are subject to our acceptance and availability. Items that are placed in your shopping basket are not reserved and may be purchased by other customers. We will inform you if we are unable to fulfill your order. We may choose not to accept your order in our discretion for any reason without liability to you. Examples of occasions we may not accept your order are: that we are unable to obtain authorisation for payment; shipping restrictions apply to a particular item; the item ordered is out of stock; the item ordered does not satisfy our quality control standards and is withdrawn; or that you do not meet the eligibility criteria set out within the Terms.

We are under a legal duty to supply goods that conform with their description on the website.

Please note that we may refuse to process an order that is a multiple of a single product, for example an order for three of the same dungarees, in the same colour.

We may also refuse to process and therefore accept a transaction for any reason to anyone at any time at our sole discretion. This includes refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

After submitting an order to us, we will send you an order acknowledgment email. This email will include your order number, details of the items you have ordered from us and delivery details. Please note that this email is an acknowledgement of your order and is not an acceptance of your order.

Acceptance of your order and formation of a contract of sale takes place when your order has been dispatched and we have sent you an email confirming this.

When placing an order for the first time, you may be required to or may be offered the option to register with us and complete certain required fields on an order form. Where we ask you to provide and use identifiers and passwords to access restricted parts of the Website, it is on condition that you shall be responsible for ensuring that such identifiers and passwords are kept secure and confidential at all times. You shall comply with all security directions and/or recommendations given by us and inform us immediately if you become aware or suspect any unauthorised use of your account.

Custom orders are welcomed and delivered with customer satisfaction in mind. If you would prefer different colours or sizes, let me know. When taking your child’s measurement (standing upright), keep the flexible tape measure straight and parallel to the floor. When placing your order, please include the measurements in the ‘Order notes’ box for our information. Happy to accommodate your needs!

Please note that if your child’s body measurements aren’t provided, and you just select the standard size, I shall make the clothing item the standard size. If measurements aren’t received, please bear in mind that there is no refund or exchange as these garments are handmade only for you. Thanks for your understanding.

 

ACCEPTANCE OF YOUR ORDER

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.

Unless you cancel your order, acceptance of your order and completion of the contract between you and the Lili June Company will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Glasgow, Scotland and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of Lili June Company.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able to. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

 

PAYMENT

Payment for all orders is at point of sale and not at point of dispatch. Payment must be made using our online payment facility by credit / debit card or PayPal.

The total cost of your order is the price of the products ordered plus the delivery charges, which are added on the checkout page.

Payment will be debited from your account upon placing your order by Lili June Company. By entering card details onto our system you confirm that the credit or debit card being used is yours. All credit / debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

To be eligible to purchase products on this website you must be over 18 years of age, stipulate a delivery address in the United Kingdom, Europe or anywhere else in the world (PO box numbers and hotels are not acceptable) and possess a valid credit or debit card.

By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. We reserve the right to reject any offer of purchase by anyone at any time.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using PayPal, a secure online payment gateway that encrypts your card details in a secure host environment.

We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

I’m happy to make arrangements if you can’t afford to buy the items at once, don’t be embarrassed to ask about payment plans or to hold an item for you. No reasonable request is refused.

 

ORDER PROCESSING TIME

Most orders will be made and dispatched within 1-3 weeks. During busy periods, for custom orders or large orders you will be notified of any delays or if we expect that the processing time will be longer than usual.

 

CONTRACT CANCELLATION

If you change your mind you’re entitled to cancel a purchasing contract, provided you do so no longer than fourteen days after the day on which you receive the products. You’ll be given a full refund, which includes the initial postage charge. Please note that this does NOT apply to bespoke, custom made pieces. Please see our Delivery & Returns policy below for more details. If you wish to cancel this contract prior to order dispatch, please contact us as soon as possible. If your order has already been dispatched please follow the procedure set out in our Returns Policy.

 

SHIPPING COSTS

– UK Postage small parcels £4.00 plus £1 for each additional item – 2-5 business days via Royal Mail Signed for

– European and international postage £13 plus £1 for each additional item- 5-7 business days Via International Tracked and Signed

 

International customers please note:

Purchase price and shipping fees do not include payment of your local taxes, tariffs, duties, receiving and/or handling fees, etc. These are the additional responsibility of the purchaser.

 

SHIPPING

Orders are dispatched Monday to Friday excluding public holidays.

When placing your order please ensure that the billing and shipping address details are correct, as we are unable to redirect.

When your order is shipped, we will send you a confirmatory email.

A signature will be required upon delivery of your order. Please be aware that our service is not a named delivery service and anyone at the designated delivery address may sign for your delivery. We will not be liable for a lost or missing order that has been signed for in a building, for example an office address that has been provided for delivery.

Delivery times are estimates and start from the date of dispatch. Please note that in some areas of the United Kingdom and Europe there is a limited range of delivery services available. We will endeavour to send your order out as quickly as possible but we cannot be responsible for delays as a result of remote delivery locations or adverse weather conditions.

INSURANCE AND DELIVERY

We insure each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by the Lili June Company, and transfer of responsibility in the same way.

Estimated delivery times are to be used as a guide only and commence from the date of dispatch. The Lili June Company are not responsible for any delays caused by destination customs clearance processes.

 

PRODUCT PRICING & DESCRIPTIONS

All prices published are in pounds sterling. Each product purchased is sold subject to its Product Description, but please do remember that handmade clothing is not mass-produced and therefore slight variables in design and colour are always possible.

The actual colour shown may slightly differ due to computer monitors. No photos have been photo shopped so colouring should be as appears. If you do have any queries please send me a convo and more photos can be supplied to ensure customer satisfaction.

 

STOCK AND DELIVERY

Ready made items will be leaving our studio in 1-2 days. Bespoke handmade garments require longer delivery periods as they are made to order, so please do bear this in mind if you are ordering a gift for a specific time. We work very hard to meet the delivery times quoted on our site, but please bear in mind that these are estimates and postal services aren’t always as reliable as we’d like them to be! At times of public holidays (e.g Christmas, Easter and bank holidays) delivery may take a little longer.

COMMISSIONED ITEMS

I take commisioned work but I shall need to discuss your needs and design a bespoke piece just for you. A non-refundable full payment, payable at the beginning of the order, may be arranged and you’ll be given clear guidance on full costs and expected delivery times. Once a commissioned piece is ordered and a deposit or full amount has been paid it usually cannot be cancelled unless specifically by agreement with lilijune.com. Please note that your cancellation rights are affected once a commission is started – see below for more details. We are unable to offer refunds for completed commissioned/bespoke pieces.

 

RETURNS AND REFUNDS

We hope that you’ll be very happy with your purchases from lilijune.com, but understand that you may change your mind and wish to return an item and seek a refund. If this is the case you need to let us know in writing no longer than 14 days after the date on which you received the products. This excudes items that were part of a custom order.

Please email us on info@lilijune.com with your contact details and your order details and let us know why you are returning an item so that we can put things right for you. You’ll then be sent a returns address and details of how to proceed.

Please return your item in good condition, ideally with its original packaging within 14 working days from the date you received the products. The refund does not include the original delivery charge but please note that we’re unable to offer free returns at this time.

If you return goods to us, please use an insured method of dispatch and obtain proof of posting. We can’t accept liability for returned goods being lost or damaged in transit.

Currently item(s) may not be exchanged; we ask you to place a new order with us online.

Items should be returned, unused and with all garment tags still attached. Returns that are damaged or soiled may not be accepted and may be sent back to you and/or a refund refused.

TO RETURN YOUR ORDER

– Package your item well including all cards, labels

– Arrange for postage to Lili June Company, 16 Birch Grove, G72 7LW, Cambuslang, South Lanarkshire, Scotland.

– You will have to bear the cost of returning the goods

We recommend that you insure the return shipment as you are under a duty to take reasonable care of the items and will be liable for damage to them until we receive them at our studio. In case of dispute, we also recommend you retain proof of sending. We cannot be responsible for any loss for any item(s) you have chosen to send.

All custom orders are excluded from the returns policy.

 

REFUNDS

Refunds will be credited to your original method of payment. Original shipping charges will not be refunded and you will be liable for the cost of return postage.  If your return was purchased in a currency other than your local currency, refunds will be paid in the same currency. Due to fluctuations in currency rates the amount refunded may be slightly higher or lower than the price originally paid. On receipt of return, we shall process the refund as soon as possible.

 

FAULTY ITEMS

Items are faulty if they are received damaged. Items that are damaged as a result of normal wear and tear are not considered to be faulty. Where possible, we will offer to repair faulty items. When items deemed faulty cannot be repaired or the same item is not available, a full refund will be offered.

 

CANCELLING YOUR ORDER

If you are based in the EU under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (ICACRs), you have the right to cancel your order with us provided you give us written notice.

You have the right to cancel your order within 14 days without giving any reason.

The cancellation period will expire 14 days from the day after the day on which you acquire (or a third party other than a carrier and indicated by you acquires) physical possession of the last of the goods.

To exercise the right to cancel, you must inform us by email to: info@lilijune.com

For orders cancelled under the ICACRs, we will issue you with a full refund excluding the shipping cost paid by you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make reimbursement without undue delay, and not later than:(i) 14 days after the day we receive back from you any of the goods supplied; or
(ii)(if earlier) 14 days after the day you provide us with evidence that the good have been returned; or (iii) if no goods were supplied, 14 days after the day on which we are informed about your cancellation.

We will make reimbursement using the same means of payment as you used for the initial transaction.

In the event that we have sent goods to you and you have cancelled your order, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is the earliest.

You shall return cancelled orders to: Lili June Company, 16 Birch Grove, G72 7LW, Cambuslang, South Lanarkshire, Scotland without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of the contract to us. The deadline is met if you send the goods before the period of 14 days has expired.

You will have to bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling, other than what is necessary to establish the nature, characteristics and functioning of the goods.

Please note you may only use your right to cancel the order under the ICACRs if you give us formal written notice of cancellation any time after your order has been placed, up until 14 calendar days from the day after you receive your order, by email.

 

USE OF WEBSITE

The Website and related services (including any applications which allow you to buy our products from us on mobile devices) (the “Services”) are made available to you in accordance with the following Terms of Use, and any other rules posted on our websites on the Terms and Conditions page (“T & C”). Please read the Terms and Conditions (“T & C”) carefully before placing any orders, and we recommend you should keep a copy of the Terms and Conditions (“T & C”) for future reference.

We may modify the Terms and Conditions (“T & C”) from time to time at our sole discretion. Please read the Terms and Conditions (“T & C”) and check back often. If you do not agree to any change to the Terms and Conditions (“T & C”) then you must immediately stop using the Lili June Services.

Please note that these Terms and Conditions (“T & C”) do not affect your statutory rights as a Consumer. For more information about your rights contact your local Citizens Advice Bureau or Trading Standards Bureau.

You agree that the information that you provide when you register is true, accurate, current, and complete in all respects. Should any of your registration information change, please notify us immediately. We may also change registration requirements from time to time.

We may change, withdraw, or suspend access to the Services (in whole or in part and permanently or temporarily) with or without notice and with no liability to you.

The Services may include links to other websites or resources. We have no control over the content of these websites and are not liable in any way for their content.

Any material that you upload to the Website or which you send to us via any other medium (including all social media) will be considered non-confidential, non-proprietary and we will have the right to use, copy, distribute and disclose to third parties such material for any purpose. We also have the right to disclose your identity to any third party who claims that such material infringes their intellectual property rights or their right to privacy.

We will not be responsible or liable to you or any third party for the content or accuracy of any materials posted by you or any other user of the Services and you agree to be responsible to us for and indemnity us and keep us indemnified against all costs, damages, expenses, losses and liabilities incurred and/or suffered by us as a result of any claim in respect of your use of the Services.

We have the right to remove any material or posting you make on the Website at our sole discretion.
